NOTICE OF PRIVACY PRACTICES
This Notice describes how medical and mental health information about you may be used and disclosed, and how you can access this information. Please review it carefully.
OUR LEGAL DUTIES
Knight Therapy Services is required by law to:
Maintain the privacy and security of your Protected Health Information (PHI)
Provide you with this Notice of Privacy Practices
Follow the terms of this Notice currently in effect
Notify you in the event of a breach of unsecured PHI
HOW YOUR PHI IS STORED AND MANAGED
Knight Therapy Services uses SimplePractice, a HIPAA-compliant electronic health record (EHR) system, to store and manage client information. SimplePractice provides:
Secure storage of clinical records
HIPAA-compliant client messaging
Secure telehealth services
Electronic billing and documentation
Access to your PHI is limited to authorized providers and staff and protected through administrative, technical, and physical safeguards.
HOW WE MAY USE AND DISCLOSE YOUR PHI
1. Treatment
We may use and disclose PHI to provide, coordinate, or manage your behavioral health care.
Examples include:
Therapy sessions and treatment planning
Clinical documentation within SimplePractice
Consultation with other providers involved in your care, when appropriate
2. Payment
We may use and disclose PHI to obtain payment for services, including:
Insurance billing
Claims submission through SimplePractice
Payment processing and collections
3. Health Care Operations
We may use PHI for practice operations, such as:
Quality assurance and supervision
Practice management
Compliance and administrative review
ELECTRONIC COMMUNICATION & CLIENT PORTAL
SimplePractice offers a secure client portal that may be used for:
Scheduling
Secure messaging
Telehealth sessions
Intake forms and documents
While the client portal is secure, email and text messaging outside the portal may carry privacy risks. By choosing to communicate outside the portal, you acknowledge and accept those risks.
TELEHEALTH SERVICES
Telehealth services are provided through SimplePractice’s HIPAA-compliant video platform. While reasonable safeguards are in place, no electronic system is entirely risk-free.
Clients are responsible for:
Ensuring privacy on their end
Using secure internet connections when possible
OTHER PERMITTED OR REQUIRED DISCLOSURES
We may disclose PHI:
As required by federal or Illinois law
To prevent serious and imminent harm to you or others
For reports of abuse, neglect, or domestic violence
In response to court orders or legal processes
Illinois law may require additional authorization for certain mental health disclosures.
USES AND DISCLOSURES REQUIRING WRITTEN AUTHORIZATION
We will obtain your written authorization before:
Releasing psychotherapy notes (except as permitted by law)
Using PHI for marketing purposes
Sharing information with third parties not involved in treatment, payment, or operations
You may revoke authorization in writing at any time, except where action has already been taken.
YOUR RIGHTS
You have the right to:
Access and obtain a copy of your records (with limited exceptions)
Request corrections or amendments
Request restrictions on certain uses or disclosures
Request confidential communications
Receive an accounting of disclosures
Obtain a paper copy of this Notice
Requests must be submitted in writing and may be processed through SimplePractice.
SPECIAL MENTAL HEALTH PROTECTIONS
Mental health records are subject to additional protections under Illinois law. Certain disclosures require explicit written authorization, even when HIPAA permits disclosure.
COMPLAINTS
If you believe your privacy rights have been violated, you may file a complaint with:
Knight Therapy Services, or
The U.S. Department of Health and Human Services
You will not be retaliated against for filing a complaint.
